Under the terms of nbn’s Wholesale Broadband Agreement, nbn and its customers agree to manage and resolve disputes that may arise under or in relation to the WBA in accordance with a set of rules that are set out in module G of the WBA. These Dispute Management Rules provide that certain functions and responsibilities are to be performed by an appointee to the role of ‘Resolution Advisor’.
On 6 April 2016, nbn re-appointed Endispute Pty Ltd as Resolution Advisor until 31 October 2016, with the performance of the Resolution Advisor functions to be carried out by Professor Tania Sourdin. The re-appointment was subsequently extended until 31 October 2017.
In light of the upcoming expiry of that appointment, nbn is considering the re-appointment of Endispute Pty Ltd as Resolution Advisor for a further period to broadly align with expiry of the next version of the Wholesale Broadband Agreement (WBA 3).
Accordingly, nbn has issued this Consultation Paper to initiate consultation with Customers and Access Seekers on a proposal to re-appoint Endispute Pty Ltd, with the performance of the Resolution Advisor functions to be carried out by Professor Sourdin, for a period of 2 years, with a further option to extend the appointment until 31 October 2020.
nbn is also proposing to appoint the same Resolution Advisor (Professor Sourdin) for all access agreements that contain the Dispute Management Rules. Appointing the same Resolution Advisor for all such agreements creates efficiencies and will promote consistency in the application of the Dispute Management Rules.
