Under the terms of nbn's Wholesale Broadband Agreement, nbn and its Customers agree to manage and resolve disputes that may arise in relation to WBA in accordance with a set of rules that are set out in Module G of the WBA. These Dispute Management Rules provide that certain functions and responsibilities are to be performed by an appointee to the role of 'Resolution Advisor', and that in the event of panel arbitration, the panel members are selected from a pool of Pool Members. This same dispute regime applies to supply under any of nbn's Standard Form of Access Agreements.
In March 2015, nbn appointed its second tranche of Pool Members under the Dispute Management Rules. The term of those appointments was for 2 years and expire in March 2017. In these circumstances nbn is proposing to extend these appointments by way of re-appointment for a further 2 year period. In addition, nbn is also proposing to introduce 3 new appointments to the Pool for the same 2 year period.
The purpose of this consultation process is to seek the views of Customers and Access Seekers on candidates for appointment to the Pool. For the avoidance of any doubt, Customers and Access Seekers are not required to provide any feedback or make any submission in regard to the proposed appointment of these Pool Members, however they may choose to if they wish. nbn welcomes your feedback on this consultation paper and requests that Customers and Access Seekers send any feedback to nbn Wholesale Supply at firstname.lastname@example.org by 5:00 pm on Friday 7 October 2016.
